SUPERVISORíS REORGANIZATION
& Business MEETING

January 6, 2003

The Jackson Township Supervisors held their Reorganization / Business meeting at 7:00 p.m. in the municipal building. Members present were David Bracken, Bob Stephens, Bruce Baker and Dave Hirko. The meeting was called to order by David Bracken, Chairman, with the Pledge of Allegiance to the flag.

Acting Chairman
Motion Baker, second Bracken to appoint David Bracken as Acting Chairman for the Reorganization Meeting. Vote-3 yes.

Public Comments:
Delores Kimbel expressed her thanks to and commended Supervisors Bracken & Baker for lowering the property taxes in Jackson Township. She stated that this was the first time in 47 years that property taxes were lowered.

Will Michaels stated he was upset that when questions were asked of the Supervisors at meetings concerning various issues, he wouldnít get an answer yet when the news media calls, the Supervisors tell them everything they want to know.

Steve Yurasek asked if a property is zoned half in one zone and half in another, what procedure would you have to go through to get it all zoned in one zone classification. He stated that he purchased the former Gulf Oil Property and according to the zoning map, Ĺ of the property is zoned Commercial and the other half Agricultural. He wanted to know what procedure he would have to go through to have it zoned all industrial and / or commercial. Mr. Yurasek asked if the map could be changed or if he would have to obtain an attorney and go through a lengthy process. Supervisor Baker said he would check into it and give him a call with the correct information to answer his questions. .

Clair Michaels stated that on the agenda it was shown that the Township would vote to retain Berkheimer Associates to collect the Earned Income Tax and Occupational Privilege Tax. He asked why someone in the Township couldnít collect those taxes or use the Paulette Baker, the Tax Collector that we have and keep the money in the Township. Supervisor Baker said we really didnít have a choice at this time as it would automatically roll over to Berkheimer unless the Township would have notified them otherwise by September of 2002. Supervisor Baker also said that is was a large amount of taxes that Berkheimer collected and during 2002 they collected approximately $290,000.00. He stated that they go after delinquent tax payers and the fees they charge to collect the taxes are minimal at 3% or approx. $8800.00. Mr. Michaels asked if someone in the Township couldnít collect the taxes and get paid the same fee? Supervisor Baker said he didnít know if anyone in the Township would be qualified to preform the same services that Berkheimer provides. Supervisor Bracken said if the taxes were collected by someone in the Township and the total taxes due were not collected, the Supervisors could be surcharged for that amount. Supervisor Stephens said he spoke to Paulette Baker, Tax Collector, and that she said she was qualified to collect the taxes. George Burkey said that formerly a Township resident collected the E.I.T. & O.P. Taxes and when Berkheimer took over that function, thousands of additional dollars were brought into the Township. Mr. Burkey went on to say that Berkheimer makes sure that everyone pays rather than just the people who voluntarily pay it. He stated that we should not go backward in time. Supervisor Baker also said that Berkheimer supplies all the forms and paperwork. Mr. Burkey said that the Township pays Paulette Baker for the tax forms and supplies whereas Berkheimer provides their own at no extra cost to the Township.

Motion Baker, second Stephens to appoint Dave Bracken as Chairman. Vote-3 yes.

Motion Bracken, second Baker to appoint Bruce Baker as Vice-Chairman. Vote-3 yes.

Motion Stephens, second Baker to appoint Dave Hirko as Secretary-Treasurer. Vote-3 yes.

Motion Stephens, second Baker to appoint Dave Bracken & Bruce Baker as Roadmasters. Vote-3 yes.

Motion Baker, second Stephens to affirm the Supervisors as employees of the Township. Vote-3 yes.

Motion Bracken, second Baker to appoint Bill Barbin as Solicitor. Vote-Bracken & Baker-yes, Stephens-no.

Motion Baker, second Stephens to appoint Lehman Engineers as Township Engineer. Vote-3 yes.

Motion Baker, second Bracken to appoint Barry Rouzer as Vacancy Board Chairman. Vote-Baker & Bracken-yes, Stephens-no.

Motion Baker, second Stephens to appoint Harry Baker as Zoning Officer. Vote-3 yes.

Motion Baker, second Bracken to retain Berkheimer Associates for E.I.T. and O.P.T. collection. Vote-3 yes.

Motion Stephens, second Baker to retain First National Bank of PA, Ameriserv Bank and PLIGIT as depositories for the Township. Vote-3 yes.

Motion Stephens, second Baker to set meeting dates for 2003 as the last Thursday of every month with the exception of November 20th and December 18th. Vote-3 yes.

Motion Baker, second Bracken to set Tax Structure as follows: 7 mill Real Estate, 1 Mill Fire Hydrant, Ĺ Mill Rescue Service, 1/2% Earned Income Tax, 1/2% Real Estate Transfer Tax, $5.00 Per Capita Tax, $5.00 Occupational Privilege Tax. Vote-Baker & Bracken-yes, Stephens-no.

Motion Stephens, second Baker to authorize the Supervisors and Manager to attend County and State Conventions.

Motion Baker, second Stephens to appoint Dave Bracken as Voting Delegate to the State Convention. Vote-3 yes.

Motion Bracken, second Baker to appoint Bruce Baker as Alternate Voting Delegate to the State Convention. Vote-3 yes.

Motion Stephens, second Baker to approve the Fire Companyís list of activities for 2003. Vote-3 yes.

Motion Stephens, second Baker to appoint Dave Hirko as Driveway and Street Encroachment Officer. Vote-3 yes.

Motion Stephens, second Baker to authorize reimbursement of the Auditorís expenses for attendance at Seminars and Conventions. Vote-3 yes.

Motion Stephens, second Baker to authorize reimbursement of the Zoning Officerís expenses for attendance at Seminars and Conventions. Vote-3 yes.

Supervisor Bracken explained the policy used in the past for Emergency Snow Plowing. He said there was a form that the resident had to sign and then a Supervisor also had to sign the form. He went on to say that the Township often verified the emergency as in the case of someone requesting a delivery of heating oil. Supervisor Stephens stated that as he recalled, emergency was defined as police, fire or ambulance service. Supervisor Bracken said he didnít believe that emergencies were defined as a wide variety of possible emergencies could exist Steve Yurasek said that if someone was sickly or needed to even get out to purchase food, that would be understandable. Supervisor Baker said common sense should prevail in each situation.

Motion Baker, second Stephens to continue the current policy for snow plowing only in cases of emergencies. Vote-3 yes.

Motion Stephens, second Baker to appoint Rob Piper to a five year term to the Jackson Township Water Authority. Vote-3 yes.

Motion Baker, second Bracken to appoint George Burkey to a five year term to the Jackson Township / East Taylor Township Sewer Authority. Vote-Baker & Bracken-yes, Stephens-no.

Motion Bracken, second Baker to appoint Bruce Baker to a four year term to the Jackson Township Planning Commission. Vote-Bracken & Baker-yes, Stephens-no.

Motion Baker, second Bracken to appoint Rick Fetzer to a three year term to the Jackson Township Zoning Hearing Board. Vote-Baker & Bracken-yes, Stephens-no.

Motion Stephens, second Baker to appoint Alfred George to a five year term to the Jackson Township Recreation Commission. Vote-3 yes.

Motion Baker, second Stephens to appoint Dave Hirko as Attending Member to the Cambria County Sewage Enforcement Agency. Vote-3 yes.

Motion Stephens, second Bracken to appoint Bruce Baker as Alternate Attending Member to the Cambria County Sewage Enforcement Agency. Vote-3 yes.

Motion Bracken, second Stephens to appoint Christine Williamson as Auditor until the next general election. Vote-3 yes.

Minutes:
Motion Baker, second Stephens to approve the minutes of the December 19th meeting. Vote-3 yes.

Correspondence:
Letter from Chad Cessna, Part-Time Police Officer stating that he would not be able to work for Jackson Township at this time due to schedule conflicts.

Motion Bracken, second Stephens to accept the letter received from Chad Cessna. Vote-3 yes.

Business:
Motion Baker, second Bracken on hiring Part-Time Policeman Daniel Gonos. Vote-Baker & Bracken-yes. Stephens-no.

Supervisor Stephens explained that he voted no as there were three other applicants that were not interviewed. Supervisor Bracken said that one of the applicants didnít show up for the first interview and one had too many jobs. He went on to say that one applicant actually had a robbery charge against him.

Motion Stephens, second Baker to establish 3 sick days and 2 personal days per year for Township office employees. Vote-3 yes.

Motion Baker, second Stephen to approve the time sheets for December 8th to 21st Vote-3 yes.

Motion Baker, second Stephens to adjourn the meeting at 7:40 p.m. Vote-3 yes.
