SUPERVISOR’S MEETING
January 11, 2007

The Jackson Township Supervisors held their regular meeting at 8:00 a.m. at the Jackson Township Municipal Building. Members present were Supervisors Dave Bracken and Bruce Baker along with Secretary-Treasurer / Manager Dave Hirko and Solicitor Bill Barbin. The meeting was called to order by Bruce Baker.

Board Roll Call was taken with Supervisors Dave Bracken & Bruce Baker present. Supervisor Bob Stephens was absent.

Executive Sessions Held:
Chairman Baker
announced, an Executive Session was held on Thursday, January 4, 2007 from 6:30 pm to 8:00 pm to discuss a lease with the Chickaree Ridgerunners Snowmobile Club.

Other New Business:
Motion Bracken, second Baker to approve the joint purchase with Cambria Township for a Lee Boy Model 8510TE Asphalt Paver from Stephenson Equipment Inc. on State Contract # 2420-02 for the price of $107,786.00 with $25,000 of that amount being paid by Shared Municipal Services Grant. Vote-2 yes.

Motion Bracken, second Baker to authorize the submission of the PennDOT application for 2007 County Aid for road projects. Vote-2 yes.

Motion Bracken, second Baker to increase the regular meeting pay from $25.00 to $50.00 for members of the Jackson Township Zoning Hearing Board. Vote-2 yes.

Motion Bracken, second Baker to compensate members of the Jackson Township Planning Commission at the rate of $50.00 per meeting to be paid quarterly. Solicitor Barbin commented, you can vote in the event of a conflict but you have to state your conflict situation for the record. Chairman Baker said, I can’t accept it anyway, correct? Barbin replied, I don’t think so. . not until a new term. No one will receive it during their current term. You can’t raise or lower a person’s compensation during their term of office. Baker asked, even though there’s no current compensation? . . they’re not compensated now. Barbin said, I’ll check into it but I’m thinking about the rule in the Pennsylvania Constitution. . there are some exceptions they’ve written into the law because you see Judges pay go up, you see the Legislatures pay go up, but the general rule says no. Baker stated, I am a member of the Planning Commission and majority cannot be achieved no other way. A vote was then taken. Vote-2 yes.

Public Comments:
Eugene Kist
commented, I asked a question at the last meeting on the dump and nobody attempted to answer me. . maybe I can one this evening from Mr. Hirko. . .is there a bond on that dump up there? I’m not a legal expert. Manager Hirko replied, I’m sure they have all kinds of regulations. Kist said, if there’s not a bond on it, it’s going to come back as a liability onto the Township. Hirko said, I would think they would have to be covered by heavy regulations. Kist said, there would have to be a bond. . I’m no legal expert or anything. Clair Michaels said, all the stuff I got on the garbage dump when they were first building it. . I got stuff on it. . .the garbage. . once they close, they have to maintain it for 10 years afterwards and then after that, the State is supposed to pick it up. . anything on a water situation or something like that. . I think that’s what Eugene is talking about. Kist said, no . . I’m talking about a liability coming back onto the Township. Nobody can seem to answer this question, because I don’t want to be liable for this darned dump. . I hope you don’t call me out of order for raising my voice but at the same time, I don’t want to be liable. You have children in this Township. . .every one of us do. I don’t want to see them be liable for something like this and there’s no darned un-God sense in it and this is America. . if we can’t speak our own words, it’s darned time to quit. . . we might as well move to Iran. Steve Yurasek said, you could call the DEP. Kist replied, I’m not going to. . I’m talking to these gentlemen here. . not the DEP. . I don’t believe a damn thing they say. Yurasek said, no matter what you say, when it comes to moving Earth, you’ll have a bond. Kist said, I am not talking about DEP. . we have to have a legal legality of it in our Township. Chairman Baker said, perhaps we can check with them and see if there’s any information. Kist said, all you gentlemen have high school educations. . I’ve been on a Board a couple of times and we never had a Solicitor at every meeting. Damn it. .I think you should be able to sit down and say something. . you know that? You’ve been through 3rd grade. Take it up for consideration. We have funds but there’s no funds that should be throwed away.

Announcements:
Chairman Baker
announced, The Board of Supervisors next scheduled meeting will be held on Thursday, January 25, 2007 at 7:00 pm at the Jackson Township Municipal Building. Also, The Cambria County Redevelopment Authority will hold two meetings concerning Jackson Township’s Community Block Grant Funds for 2007. They will be held on Thursday, January 18th at 10:00 am and Wednesday, January 31st at 2:00 pm.
