SUPERVISORíS MEETING
July 14, 2011

The Jackson Township Supervisors held their regular meeting at 8:00 a.m. at the Jackson Township Municipal Building. Members present were Supervisors Bruce Baker, John Wallet and Mark Westrick along with Solicitor Bill Barbin. Secretary-Treasurer / Manager Dave Hirko was not present due to working at the Jackson Heritage Festival. The meeting was called to order by Chairman Bruce Baker with the Pledge of Allegiance to the flag.

New Business:
Motion Wallet, second Westrick to exercise Purchase Option Agreement to acquire approximately 33 acres of land on the south side of Laurel Ridge Road from Waste Management for the price of $78,571.00 from Waste Management to be used for the development of the Jackson Township Business Park Project. Vote-3 yes.

Steve Yurasek
said, when you discussed that Nuisance Ordinance, you said that basically you were doin this to help out what ya call it down here about the noise but then in the paper, it didn't quite say that. What it said was that you had so many complaints about. Solicitor Barbin said, that we're going to crack down on everybody. Yurasek said, I thought how did they get from here to there. . so now we're going to do a hatchet job on everybody in the Township?. . I don't think so. Chairman Baker said, you're right. . I don't think so either. That was the news reporter coming out here and sensationalizing. . and that's what they do and quite frankly, none of us knew that was even going to be in there. Yurasek said, you know that's kind of bullshit when they print stuff like that without goin through somebody specific who gives them authority to print that stuff. . . yeah. . they made it sound like the Township was gonna do a hatchet job on everybody. Baker said, no. Barbin said, and no, that scares everybody away. Baker said, that's not our intent. . you're right. George Burkey said, I had a guy who hadn't slept for three nights and come to my house yesterday and asked me, are you going to come after me?. . and it was clear in back of the yard somewhere. Baker said, that's just an example of the press. Yurasek said, Tuesday I was at the gas station down here and a guy was gasin up and he said, man, I got to cut my grass. . I'm liable to arrested. Barbin said, that's not altogether bad Steve. Yurasek said, no it's not but you know. . like I said before, we're able to cut grass but what about these elderly people. . I don't think that's right. Baker said, it has to be an unreasonable. . and we decide that. Barbin said, we added the word unreasonable. . Al Gailey brought that up at the Planning Commission. I got an older neighbor and it has a real steep hill and it would be impossible for them to keep the grass cut there and we added that unreasonable language in there to make for special cases. Baker said, you have to be reasonable in enforcing things like that. Yurasek said, there's not one size fits all. Baker replied, no because it doesn't. Barbin said, although you try because you want equality. You want rules to be equal to. . . there's a fair balance and that's what we got to find. Baker said, last night the Johnstown City Codes Officer said to me, what are you trying to do up there?. . .trying to trump us. . one up us? . . .a foot. . that's pretty lenient. . isn't it? I said no, that's not lenient enough. Yurasek said, but you take in the city, you tear a house down. . the city owns the lot because they put a lien on the lot and it cost you to tear it down what the lot's worth. Somebody gotta cut the grass so you know. . it's like cuttin off our nose despite our face here. We ain't got the manpower. . we can't afford to cut every one. Barbin said, the Redevelopment Authority spends a lot of money maintaining the lots they own. . . they got lots everywhere. Yurasek said, that's the problem. . you either pay taxes or the Redevelopment Authority gets the lot. . fine. . but if the grass grows, you gotta cut it or you can put stone on it and give it a few years. . the grass grows up through the stone anyway. Baker said, it makes more sense if you just plant grass from the get go and just have a nice mowed lawn because if not, it's spotty and looks ugly.

Solicitor Barbin said, we got the deed yesterday. . I recorded the deed and we now own that 100 acres and we did the land swap. . we finally got finished yesterday with the State. Chairman Baker said, yes. . it took two years.

announced, The Board of Supervisors next scheduled meeting will be held on Thursday, July 28, 2011 at 7:00 pm at the Jackson Township Municipal Building.
