JANUARY 15, 2007

REORGANIZATION MEETING

Al Gailey served as acting chairman.

Following the Pledge of Allegiance, the meeting was called to order by Al Gailey at 6:30 p.m.

Roll Call
All members were present.

New Business
Don Knopsnyder made a motion to appoint Al Gailey as Chairman. Al declined the nomination. Al Gailey made a motion to appoint Don Knopsnyder as chairman. Bruce Baker seconded the motion. All in favor. Motion passed.

Bruce Baker made a motion to appoint Paul Wyrwas as Vice Chairman. Don Knopsnyder seconded the motion. All in favor. Motion passed.

Don Knopsnyder made a motion to appoint Bruce Baker as Secretary. Laird Rager seconded the motion. All in favor. Motion passed.

Don Knopsnyder thanked Al Gailey for doing an excellent job as chairman during the last year.

REGULAR MEETING

The Jackson Township Planning Commission meeting was called to order by Chairman Don Knopsnyder on January 15, 2007 at 6:35 p.m. All members were present.

Public Comments
There were no public comments.

Minutes
There was a correction to the minutes of the December meeting. The correction is as follows: Bruce Baker made a motion to adjourn the meeting at 7:35 p.m. and the motion was seconded by Paul Wyrwas. Al Gailey made a motion to approve the minutes as corrected. The motion was seconded by Bruce Baker. Motion passed.

Correspondence
Memo from supervisors reappointing Bruce Baker to another four-year term.

Bruce Baker stated that the supervisors voted to pay the Planning Commission members for meeting attendance quarterly.

New Business
The permit application of Fordís Mobile Home Park was reviewed. Al Gailey made a motion to approve the permit. Bruce Baker seconded the motion. All in favor. Motion passed.

The permit application of Sirkoís Mobile Home park was reviewed. Laird Rager made a motion to approve the permit. Al Gailey seconded the motion. All in favor. Motion passed.

Al Gailey made a motion to appoint Don Knopsnyder and Paul Wyrwas to sit on the Central Cambria Coalition Joint Planning Commission as it is being created and developed.

The subdivision plan of Edward and Bonnie Nischalke was reviewed as presented. Jerry Thomas asked if they could review the subdivision without the sewer planning module and not ask for a vote. Don Knopsnyder said he would rather not review the subdivision without the sewer planning module. Bruce Baker said without the sewer planning module it would have to be rejected because it is incomplete. Al Gailey noted that there was a non-building waiver block noted on Lot No. 1 and the plan shows a house and a septic tank so the non-building waiver should not be on there. Jerry Thomas stated that they changed the lot numbers. Al stated that they have it noted that it was going to be used for Agricultural. He asked Jerry Thomas if that lot was going to be used for Agricultural and Jerry said no. Jerry said that they changed the lot numbers and those were typos. Al said the note said that the property and subdivided parcel are not served by any water system but that the property is because there is a well showing on the drawing. Jerry said that it is not public and Al stated that the note said public or private. Jerry said that just meant the subdivided parcel. Jerry said he would take that off that they just needed the subdivided parcel. Jerry said that he disagrees with the planning commission all the time and that this is the only municipality that he has to do the numbers this way. Don stated that the other question that the commission has is about the easement. Jerry Thomas stated that he disagrees with the solicitorís advise and that they will have a copy of the easement to show the Planning Commission that nowhere, anywhere does it say that an easement has to be recorded before a subdivision is approved and I will strongly disagree with that. Even previous to this, even in the township itself, the Planning Commission has asked me that they would like to see a copy of the agreement to be recorded when the subidivison is approved with a time frame for it to be approved to prove to the township that the easement was recorded. But to record an easement prior to submission of a subdivision plan is asinine. Don said that he thought that they need a clarification from their solicitor and he personally is not willing to review the subdivision until the sewer planning module is complete. Jerry said that according to the townshipís regulations that they can have the planning commission look at the subdivision but that they cannot ask for a vote. Don Knopsnyder said that is correct and if they ask for a vote it would have to be rejected. Jerry Thomas stated correct. Don Knopsnyder said that he personally would like to see the easement and the private road agreement. Jerry Thomas stated that was not a problem and heís agrees with that but as far as one being recorded prior to it. Al Gailey said that he agrees with Jerry because if it doesnít go through you have a recorded agreement that doesnít mean anything. Don Knopsnyder stated that he would like the township engineers to take a look at the Sewer Planning Module and any plans that accompany it. Don asked Jerry if the was going to have the engineering drawings for the spray field. Jerry Thomas said no that the spray field is not be used. He said the spray field is a backup. Don asked Jerry what were they going to use as a primary. Jerry said he didnít know exactly what the primary was going to be that Jim Cernansky was working on the module and that he didnít have access presently to the module. Ed Nischalke said that the primary was a holding tank. Bruce Baker asked Ed Nischalke if they were looking at putting in a holding tank and Ed Nischalke stated that is all they want to do. Ed Nischalke said that according to state regulations that in order to get a permit for a holding tank they have to have the sewer planning module completed that you have a place to put sewer. He said you donít have to build it and you donít have to have plans for it. The plan is that there is enough ground to accept the sewage and it has been tested and they had a soil scientist up there and he laid this thing out and it is on the map. We have a 100,000 square feet. Bruce Baker told Ed Nischalke that in order to have an approved subdivision you have to have an approved septic system and in this case you are talking about a holding tank. Ed Nichalke said that is correct. Bruce said that they would have to go to the Sewage Enforcement Agency, have that application filled out for that holding tank and that would to be approved before the subdivision could be approved. Bruce stated that is your sewage facility for this subdivision. Ed Nichalke stated that was in the module. Jerry Thomas said that may not be that and that Bruce brought up a good question. Ed Nichalke stated that it is in the module and that it says that the primary sewage system is a holding tank. Bruce said but have you applied to put a holding tank in. Ed Nichalke stated that he thought that this was what this was all about. Bruce said that there is an application through the sewage enforcement agency to apply for a holding tank. Jerry Thomas asked if the subdivision was approved first or the holding tank. He said if we have a DEP approved planning module, suppose it was sitting here right now, then before you can OK that we would have to have the permit for the holding tank. Bruce said that is correct; that is what you are using. Jerry Thomas said do you understand what we mean that we are using the spray field as a backup. He said as a backup we do not have to have any design on it. Jerry said he was not familiar with the specifics of a holding tank. Ed Nischalke stated that when they applied, they filled out an application for a holding tank. Jerry Thomas said that when the module is completed the sewage permit is OK and Ed Nischalke said that is right. Bruce said the permit has not yet been sent to the township. Ed Nischalke stated that he already signed the agreement to get the holding tank clean and the township signed that agreement. Don Knopsnyder said then we are waiting on the DEP, and Jerry Thomas stated that is correct. The presentation was withdrawn by the subdivider.

Old Business
A workshop on the subdivision ordinance will be held on Tuesday, January 30, 2007 at 7:00 p.m. with the Consultant present.

The zoning ordinance and zoning map will not be worked on until after the subdivision ordinance is completed.

Central Cambria Coalition: The Central Cambria Joint Planning Commission is still in the planning stages; Coalition Comprehensive Plan LUTAP grant is favorable; Rt. 22 sewer survey was reviewed and several options were presented by Dan Carbaugh of Keller Engineers.

Al Gailey made a motion to adjourn the meeting at 7:03 p.m. Bruce Baker seconded the motion. All in favor. Motion passed.
