The Jackson Township Planning Commission meeting was called to order by Chairman Don Knopsnyder on March 19, 2007 at 6:30 p.m. All members were present.
There were no public comments.
Al Gailey made a motion to approve the minutes of the February 19, 2007 meetings. The motion was seconded by Paul Wyrwas. All in favor. Motion passed.
There was no correspondence..
The subdivision of the estate of Anna Albaugh with Debbie Burkey as the executrix was reviewed and. Al Gailey made a motion to reject the subdivision due to the lack of the proper sewage permitting. Laird Rager seconded the motion. All in favor. Motion passed.
The DEP Abandoned Mine Reclamation application for NPDES permit was reviewed. The application was reviewed and Bruce Baker suggested that a letter be written to the DEP stating that a correction needed to made on the application that there is zoning, a comprehensive plan in the township and county and that the plans are consistent with the plans of the township. He also suggested that they keep us informed on this application. Bruce was going to write this letter.
The application for the mobile home permit of Robert McKool was reviewed. Bruce Baker made a motion that the application be rejected due to the following reasons:
The subdivision of Patrick DeRubis was reviewed. Al Gailey recommended rejection of the subdivision pending receipt of the following changes: Date on signature block, Item #3 Athe proposed use requires a variance@ needs removed; the project location needs to read East Taylor/Jackson; and the mylar needs submitted. Al Gailey recommended rejection of the subdivision. Baker seconded the motion. All in favor. Motion passed.
The subdivision of Edward and Bonnie Nischalke was reviewed. Bruce Baker said the township received the sewage module but it has not yet been reviewed. He said the Sewage Enforcement Agency did not approve the module yet and they cannot approve the module until the township approves it. He said the Sewage Enforcement Agency has not signed off on the module so it is not permitted. Ed Nischalke stated that this subdivision is recreational and as such it can be serviced by port-a-johns just like Mitchell Field or Leidy Park. He said there is really no requirement for a sewage permit if you use it as a recreational site. The second issue is that the court has decided that the property with the trailers were legal prior to because they were in prior to the Zoning Ordinance so I really don=t need a subdivision to have the trailers on site. He said if he wants to put a tank or a privy a permit will be needed for that. He said he would like to do a subdivision just to make it legal under your rules but from a technical standpoint right now the trailers are legal where they are at. Al Gailey recommended rejection of the subdivision until receipt of the proper sewage module. Laird Rager seconded the motion All in favor. Motion passed.
Members are to review the subdivision ordinance draft by next week. Possibly another workshop will be held if needed.
Central Cambria Coalition: Bruce Baker reported on the progress of the Central Cambria Coalition issues.
Al Gailey made a motion to adjourn the meeting at 7:00 p.m. Laird Rager seconded the motion. All in favor. Motion passed.
