PLANNING COMMISSION
MEETING MINUTES
SEPTEMBER 17, 2001

The Jackson Township Planning Commission monthly meeting was called to order by Chairperson, June Stephens, on September 17, 2001 at 6:30 p.m. All members were present.

Eugene Kist made a request to record the meeting. There were no objections to this request.

The meeting was started out with the Pledge of Allegiance and a moment of silence for the victims of the tragedy of September 11, 2001.

Public Comments
The following people voiced their objections to the Proposed Zoning Ordinance: Eugene Kist, Robert Stephens, Geena Rutledge, Edgar Westrick, Gladys Naugle, Steve Yurasek, William Michaels, William Naugle.

Bruce Baker read the portion of the State Law that pertains to burning. He explained that State Law allows a municipality to set restrictive burning regulations or to ban burning altogether. When a municipality does permit burning its ordinance may not supersede or override the minimal state requirements. The law states that commercial establishments may not burn waste.

Robert Stephens made a motion that the Board recommend to the Supervisors that they take more time to review the Proposed Ordinance. Mr. Baker informed Mr. Stephens that he could not make a motion that he could only make a request of the Board. Mr. Stephens then said he was recommending that the Commission do this. Bruce Baker stated that the Commission would take the request.

After quite a lengthy discussion concerning the Proposed Zoning Ordinance, Bruce Baker stated that the public should be sending their comments in writing to the supervisors and that we needed to move on to the regular business.

Meeting Minutes
Connie Fetzer, Recording Secretary, read the previous meeting minutes. Bruce Baker asked if there were any corrections to the minutes. There were no corrections to the minutes. A motion was made by Bruce Baker and seconded by Laird Rager to accept the minutes as read.

Old Business
There was no old business.

New Business
A discussion was held concerning the request of the Winifred Hildebrand estate seeking approval of a Minor Subdivision. A motion was made by Rick Fetzer and seconded by Tom Marhefka to accept this subdivision. All were in favor. A memo will be sent to the supervisors recommending approval of this minor subdivision.

A discussion was held concerning the request of Toni Merlo seeking approval of a minor subdivision (Lot #4 only) to Greg Kupchella. A motion was made by Bruce Baker and seconded by Laird Rager to accept. All were in favor. A memo will be sent to the supervisors recommending approval of this minor subdivision.

June Stephens asked if there was any more new business.

A motion was made by Rick Fetzer to send a letter to the supervisors stating that, at the publicís request, the Planning Commission is willing to review the Zoning Ordinance as changes occur and the Planning Commission is willing to work on any changes submitted by the County Planning Commission and/or the supervisors. The motion was seconded by Tom Marhefka. All were in favor.

A motion was made by Laird Rager and seconded by Brice Baker to adjourn the meeting at 8:50 p.m. All were in favor.
