A special meeting of the Jackson Township, Planning Commission was called to order by Chairman Paul Wyrwas on October 6, 2008 at 6:32 PM. All members were present.

New Business
The special meeting was called to review subdivision plans for pump stations sites need by the Jackson East Taylor Sewer Authority for their expansion project which is now under construction.

The first site is located on Lyle Street on property owned by Louis and Marylin Ramerez. The Ramerezes will convey 0.088 acres to JETSA for construction of a pump station. A Minor Subdivision Plan prepared by Keller Engineers was reviewed. Bruce Baker made a motion to approve the subdivision as submitted. Laird Rager seconded the motion. All in favor. Motion passed.

The second site is located on Adams Avenue on property owned by Michelle Smoter. Ms. Smoter will convey 0.136 acres to JETSA for construction of a pump station. A Minor Subdivision Plan prepared by Keller Engineers was reviewed. Al Gailey Baker made a motion to approve the subdivision as submitted. Don Knoppsnyder seconded the motion. All in favor. Motion passed.

The Minor Subdivision of Brian and Gloria Mackell to convey 4.23 acres to Wade James on Benshoff Hill Road was reviewed. Bruce Baker made a motion to approve the subdivision as submitted. Paul Wyrwas seconded the motion. Motion passed with Al Gailey abstaining because he had prepared the plan.

The Side Lot Addition submitted by George Dale and Margaret Ann Wise was reviewed. The Wyses are proposing to separate the commercial portion of their property on Pike Road from the residential portion. This will require transferring 0.18 acres from the parcel which contains all the commercial buildings to the parcel which contains their residence. The parcel to be transferred contains a two car garage attached to their residence. The resulting new parcels will require a new property line to be established between the two car garage and the shop building. The distance between the new property line and the garage will be 2.54 feet and the distance between the new property line and the shop will be 2.31 feet. The property is zoned Commercial. The Jackson Township Zoning Ordinance No. 118, Section 503, Subsection D, Item No. 2 as amended by Ordinance No. 128 requires a side yard set back of twenty five (25) feet. Don Knoppsnyder made a motion to reject the proposed Side Lot Addition because the minimum side yard setback cannot be met. Laird Rager seconded the motion. The motion passed with Al Gailey abstaining because he had prepared the plan.

The Wyses must request and obtain a variance from the Zoning Hearing Board before resubmitting the plan to the Planning Commission for a second review.

The Site Plan submitted by Douglas Mosley of New Covenant Industries Inc. for establishing a CNC Machine Shop in the basement of the former Mackall Brothers Hardware building on Harmony Drive was reviewed. Although the plan was acceptable, the property is zoned Commercial and the proposed use will be Industrial. Don Knoppsnyder made a motion to reject the Site Plan due to the zoning conflict. Al Gailey seconded the motion. All in favor. Motion passed. Mr. Mosley must now request and obtain a variance from the Zoning Hearing Board for a non-conforming use before resubmitting the plan to the Planning Commission for a second review.
